In November 2016 the co-rapporteurs delivered their draft report on the Commission's proposal for a directive on contracts for supply of digital content. They propose to expand the directive's scope to include digital content supplied against data that consumers provide passively, while also strengthening the position of consumers as regards criteria of conformity. Objective criteria would become the default rule, with a possibility to depart from them only if the consumer's attention were explicitly drawn to the shortcomings of the digital content. The Digital Content Directive was proposed as part of a legislative package, alongside the Online Sales Directive. The Council has favoured a fast-track for the digital content proposal, while seeking to reflect for longer on the proposed Online Sales Directive. Nonetheless, the Commission is keen not to dismantle the legislative package, and likewise the Parliament has been working on the two texts in parallel, seeking to coordinate amendments to the two proposals. En noviembre de 2016, los coponentes presentaron su proyecto de informe sobre la propuesta de directiva de la Comisión sobre contratos de suministro de contenidos digitales. Proponen ampliar el alcance de la directiva para incluir el contenido digital suministrado contra los datos que los consumidores proporcionan de forma pasiva, mientras que también fortalecen la posición de los consumidores en lo que respecta a los criterios de conformidad. Los criterios objetivos se convertirían en la regla predeterminada, con la posibilidad de apartarse de ellos solo si la atención del consumidor se dirigiera explícitamente a las deficiencias del contenido digital. La Directiva de contenido digital se propuso como parte de un paquete legislativo, junto con la Directiva de ventas en línea. El Consejo ha favorecido una vía rápida para la propuesta de contenido digital, mientras busca reflexionar durante más tiempo sobre la propuesta de Directiva de Ventas en línea. No obstante, la Comisión desea no desmantelar el paquete legislativo, y asimismo el Parlamento ha estado trabajando en los dos textos en paralelo, buscando coordinar las enmiendas a las dos propuestas.
